I need legal help dealing with cancer treatment?
My friend from Minnesota wants to move to Texas. We had everything planned out, bus tickets and everything. Now we're not so sure that he can move anymore because one of his ex girlfriends said something that could interfere with it. She said that since he under went his cancer treatment for leukemia when he was a minor that even though he was 18 now he could not move to Texas until he finished his cancer treatment or went to the rest of his doctors appointments since his mother was the one that signed off on all the treatment when he was underage when he had the cancer. Currently he does not have the cancer anymore and he just has 3 more doctors appointments which are more less just check ups. Whats the law concerning cancer patients receiving treatment while underage now wanting to move now that they are 18? Do they now have the say of whether or not they take the treatment or is it still up to his mother since she decided everything when he was a minor though most of the treatment? Please add references. Any help will greatly help us.

When you turn 18, you can do whatever you want, except drink alcohol.

If he is of age, the only legal obligation that would be there is if he was part of a clinical trial. BUT, its really not even a legal obligation, because they have to let you withdraw by law and ethics, from the trial at any point. What I DO want to caution him on though.... If he is still at all actively receiving treatment, he needs to stay put until he is done unless necessary. When he does move, he needs to get a referral to someone that can handle his case in the area he is moving to - his doctors would be able to help him with that. Also, he needs to make sure he can get his medical care covered when he moves. Unless this was several years ago, he would still need to be checked regularly. If there are any doubts, he should have an open and frank conversation with his doctor about moving.

He should get a referral from his current treating oncologist to another in the area where he is moving to, so there is no break in his follow up care. Now that he has turned 18, his medical treatment is up to him.
